The Official State Gazette has ruled: The Judiciary has made "Human-in-the-Loop" mandatory

On January 30, 2026, the Official State Gazette (Sec. III, p. 14480) published a document that marks a turning point in the corporate adoption of artificial intelligence. It is not a technological recommendation; it is Instruction 2/2026 of the General Council of the Judiciary (CGPJ).

Section "Four" of the directive sets out the non-negotiable principles for the use of AI. Two of them rewrite the rules of corporate compliance:

  • Principle of effective human oversight: The use of AI systems "shall always be subject to genuine, conscious, and effective human oversight [...] and such systems shall not be allowed to operate autonomously."
  • Principle of non-substitution: AI "may not under any circumstances" replace decisions, the assessment of facts, or interpretation. The inclusion of content without "personal critical validation" is prohibited.

The Domino Effect in the Corporate C-Suite

Although this directive is intended for judges and magistrates, the message for the private sector is devastatingly clear. Let’s consider the legal landscape that will unfold as early as tomorrow:

If your company is taken to court or faces a regulatory audit, and you submit a financial report, an insurance policy, or a contract generated by AI as evidence... How will you prove to a judge that the document has undergone the “personal critical validation” that the law requires of you?

Saying "we trust our team" no longer holds any weight. The regulator will require mathematical certainty and technical traceability.
